Terms of service.

These terms of agreement (the "Terms of Service") govern the relationship between you and OMI TP TEAM and its affiliates (hereinafter referred to as "OMI TP TEAM," "we," or "us") regarding your use of OMI TP TEAM's products, websites, and related services (the "Services"). Your use of the Services is also subject to OMI TP TEAM's Privacy Policy, which is incorporated into this agreement by reference.

Before accessing or using the Services, you must agree to these Terms of Service and the Privacy Policy. You may also need to register an account on the Services (an "Account"). By installing, using, or otherwise accessing the Services, you agree to these Terms of Service. If you do not agree to these Terms of Service, please do not install, use, or otherwise access the Services. Use of the Services is void where prohibited by law.

Limited License

Subject to your agreement to and continued compliance with these Terms of Service and any other relevant OMI TP TEAM policies, OMI TP TEAM grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Services for your personal, non-commercial entertainment purposes, subject to the following restrictions. You agree not to use the Services for any other purpose, including but not limited to any commercial or business purpose.

Use of the Services is subject to the following restrictions:

If you are under the age of 13, you may not create an account or access the Services. You shall restrict minors' use of the Services and prohibit children under the age of 13 from accessing them. You shall be fully responsible for any unauthorized use of the Services by minors.

We reserve the right to revoke the limited license granted to you and to ban, modify, or delete any account that violates applicable laws or these Terms of Service, at our sole discretion. In particular, we reserve the right to ban, modify, or delete any account suspected of hacking and/or cheating.

Services

All right, title, and interest in the Services (including but not limited to any products, titles, computer code, themes, objects, characters, character names, stories, dialogue, catchphrases, concepts, artwork, animations, sounds, musical works, audiovisual effects, methods of operation, moral rights, documentation, in-product chat logs, character profile information, product recordings made using OMI TP TEAM product clients, and OMI TP TEAM product client and server software) are owned by OMI TP TEAM. OMI TP TEAM reserves all rights related to its products and services, including but not limited to all intellectual property or other proprietary rights. Any attempt to obtain confidential information related to the Services is strictly prohibited and will constitute a violation of these Terms of Service.

License

You hereby grant OMI TP TEAM an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license (including the right to sublicense and assign to third parties) and the right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, rent, transmit, publicly display, publicly perform, or otherwise make available electronically, broadcast, communicate to the public by telecommunication, exhibit, perform, enter into computer memory, and use and exploit in any manner your User Content and all modifications and derivative works thereof, for the purposes of providing our Services, including the marketing and promotion of the Services. You also hereby grant OMI TP TEAM the right to authorize others to exercise any of the rights granted to OMI TP TEAM under these Terms of Service. You further grant OMI TP TEAM the unconditional, irrevocable right to use and exploit your name, likeness, and any other information or materials contained in any User Content, and any other information or materials related to any User Content, without any obligation to you. Unless otherwise required by law, you waive any attribution rights and/or any moral rights you may have in your User Content, whether or not your User Content is modified or altered in any way. OMI TP TEAM does not claim any ownership of your User Content, and nothing in these Terms of Service is intended to limit any rights you may have to use and exploit your User Content. OMI TP TEAM has no obligation to monitor or enforce your intellectual property rights in User Content.

Service Updates

You understand that the Services are an evolving service. OMI TP TEAM may require you to accept updates to the Services and to OMI TP TEAM products installed on your device. You acknowledge and agree that OMI TP TEAM may update the Services and OMI TP TEAM products with or without notice to you. You may need to update third-party software from time to time in order to continue using the Services and to play OMI TP TEAM products.

Disclaimer

The Services are provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage of trade. OMI TP TEAM does not warrant that you will be able to access or use the Services at the times or locations of your choosing; that the Services will be uninterrupted or error-free; that defects will be corrected; or that the products or Services will be free of viruses or other harmful components.

Entire Agreement

These Terms of Service, any supplemental policies, and any documents expressly incorporated into these Terms of Service by reference (including the OMI TP TEAM Privacy Policy) constitute the entire understanding between you and OMI TP TEAM and supersede all prior understandings between the parties regarding the subject matter of the Services, whether electronic, oral, or written, and whether established by custom, practice, policy, or precedent.

Force Majeure

OMI TP TEAM shall not be liable for any delay or failure to perform caused by reasons beyond its reasonable control, including but not limited to any failure to perform any obligation under this agreement due to unforeseen circumstances or causes beyond OMI TP TEAM's control (such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials).
